1. Contract. Happy Tails Dog Training, LLC, also called “HAPPY TAILS,” agrees to provide, and OWNER agrees to pay for, training for YOUR DOG according to the following terms. This represents the complete agreement of the parties and supersedes any prior negotiations. It may only be modified in writing signed by HAPPY TAILS and OWNER. This contract shall be governed by Michigan law and OWNER consents to jurisdiction in any court of HAPPY TAILS’ choosing in Kent County, Michigan.

2. Payment. OWNER agrees that all fees and charges for Training Sessions and/or Group Classes must be paid in readily available funds (including cash or money order) in advance and are non-refundable.

3. Group Class Attendance Policy: Failure by the OWNER to attend class for any reason shall result in the forfeiture of the class session. If HAPPY TAILS cancels class, the class may be rescheduled at the discretion of HAPPY TAILS. The scheduling of all Training and/or Classes is subject to the availability and discretion of HAPPY TAILS. Attendance by family members and/or household members over the age of 10 years is permitted. An adult member of the household must be present with any child(ren) under 18 years of age. Adult household member is responsible for behavior, actions and well-being of any child(ren) under 18 years of age.

Children are welcome to attend class with the understanding they are there to learn and participate as instructed by you, the parent and the trainer(s) teaching the class. An adult must handle the dog for all class exercises, but your child(ren) may assist with YOUR dog at your discretion.
We do ask that you advise your children to otherwise remain seated and not interact with other participants dogs unless given specific permission by the other owner, you AND the trainer running the class. We do this to keep everyone safe!! Not all dogs are comfortable with kids; and not all kids are comfortable interacting with dogs that are not theirs.
To keep all class participants safe, able to learn and set the class and your family up for success, we advise that if you are not 100% certain these rules will be followed, that you attend class and then provide instruction to your child(ren) at home.

4. Content of Training Sessions. All Training Sessions will be conducted by HAPPY TAILS staff in their sole judgment and discretion. Although a written course outline will be provided, OWNER acknowledges and agrees that training their DOG is dependent on the unique circumstances of the DOG. HAPPY TAILS may diverge in its training from the course outline at HAPPY TAILS’ sole judgment and discretion. OWNER agrees to cooperate with all instructions of HAPPY TAILS in and out of Training Sessions, including follow-up exercises with DOG outside of the Training Sessions. Failure of OWNER to comply with this Agreement or any HAPPY TAILS instruction is grounds for HAPPY TAILS to immediately cancel the Training Session and cancel all future training services, and OWNER will forfeit the fees for that Training Session and all other unused Training Sessions. Successful training is a result of establishing good patterns and correcting negative behavior, and is dependent on follow up outside of Training Sessions with the level of obedience established in Training Sessions. Results are varied and affected by numerous factors beyond the control of HAPPY TAILS. OWNER acknowledges that HAPPY TAILS does not and cannot guarantee the success of any training.

5. Reservation of Right to Refuse Training. HAPPY TAILS reserves the right for any reason or no reason at all to terminate its training services at any time.

6. Equipment and Training Area. Group Classes will be held at the location(s) specified on the HAPPY TAILS website and/or the Class Registration Form. OWNER agrees to provide suitable and safe equipment as requested by HAPPY TAILS. OWNER represents and warrants that it maintains adequate insurance, including liability and property damage coverage. Failure by OWNER to provide equipment as required by HAPPY TAILS will justify cancellation of training services. HAPPY TAILS may demand that persons other than OWNER be removed from the training area.

7. Behavior. Physical abuse or unsportsmanlike behavior by OWNER is not tolerated. Failure to comply will result in OWNER forfeiting all fees and all Training Sessions.

8. Photographic and Written Media Release. HAPPY TAILS occasionally uses photographs, video and/or lesson and training experiences of students and animals for advertising and/or training purposes. Written media may include but is not limited to internet blogs, brochures, and other publications. By signing this Agreement OWNER agrees and consents to use of its image and likeness of that of its animal by HAPPY TAILS.

9. Responsibility and Release. All instruction and training is provided at OWNER’s risk. HAPPY TAILS is not responsible for any injury or damage to any person, animal, or property. Further, other than the gross negligence or intentional actions of HAPPY TAILS, HAPPY TAILS is not responsible for any actions of OWNER, DOG, or other persons or animals. OWNER releases HAPPY TAILS from all liability for injury or damage to persons, animals, or property.

10. Indemnification. OWNER, jointly and severally, shall pay, reimburse, indemnify, defend, and hold harmless HAPPY TAILS and its members, employees, agents, successors, and permitted assigns from and against any and all claims, suits, actions, assessments, losses, diminution in value, liabilities, taxes, fines, penalties, damages, costs, and expenses (including reasonable legal fees), or any other threat or claim in connection with or resulting from actions of the DOG or otherwise relating to the training provided pursuant to this Agreement, except for damages determined by a court to have been caused by HAPPY TAILS’ gross negligence or intentional unlawful behavior.

11. DOG Condition. OWNER represents to HAPPY TAILS that DOG is current on all vaccinations and that DOG has not been exposed to rabies, distemper, or other disease within the last thirty days. OWNER also represents that DOG has not harmed or shown aggressive or threatening behavior towards any person or animal. OWNER also promises to immediately notify HAPPY TAILS if any of these conditions changes. Such a change in condition will justify HAPPY TAILS discontinuing training service.
